1. Agreement to Terms
By registering, logging in, or using the Avyaas website or mobile applications (distributed via Apple App Store and Google Play Store), you agree to be bound by these Terms of Service. These terms constitute a legally binding agreement between you and Ayata Incorporation.
2. Registration & Account Security
- You must provide accurate and complete registration information.
- If you log in using third-party services (Apple ID or Google Account), you are responsible for maintaining the security of those accounts.
- You are solely responsible for all activities that occur under your Avyaas credentials.
- Sharing credentials, accounts, or subscriptions with others is strictly prohibited and may result in immediate termination of access.
3. Permitted Use & Acceptable Behavior
Avyaas is an educational portal. When using the app, you agree NOT to:
- Copy, scrape, download, or distribute mock tests, video lectures, or study materials without explicit written consent.
- Post abusive, hateful, spammy, or copyright-infringing content on the public discussion boards.
- Attempt to probe, scan, or compromise the safety of the application server or containers.
4. Apple and Google Billing & Subscriptions
To access premium preparation materials, you may purchase digital plans:
- In-App Purchases: Subscriptions bought via the mobile app are processed directly by Apple iTunes or Google Play Billing and are subject to their respective terms.
- Refunds: Refunds for in-app purchases are handled directly by Apple and Google. Purchases made directly on our web portal are non-refundable unless stated otherwise.
5. Intellectual Property Rights
All source code, platform design, educational questions, answers, explanations, video lessons, and graphics are the exclusive intellectual property of Ayata Incorporation. Your subscription grants you a temporary, personal, non-transferable, and revocable license to access the content for personal study purposes only.
6. GDPR & Student Data Privacy Addendum
In accordance with GDPR and Ed-Tech security practices, we act as a Data Controller for your personal account information and educational history. We implement appropriate technical measures to prevent unauthorized data access. If you are using Avyaas under an institutional license, the terms of your educational institution may also apply.
7. Limitation of Liability
Avyaas provides preparation materials on an “as-is” and “as-available” basis. While we strive for 100% accuracy in our mock tests and question banks, we do not warrant that all content is error-free, nor do we guarantee that using Avyaas will ensure passing any specific entrance examination (such as CEE, Loksewa, or MBBS).
8. Governing Law & Termination
These terms shall be governed by and construed in accordance with the laws of Nepal. Ayata Incorporation reserves the right to suspend or terminate your account at our sole discretion if we find any violation of these terms.
